डायरेक्ट सेलर अनुबंध

यह डायरेक्ट सेलर अनुबंध ("अनुबंध") माय इंडिया ऑनलाइन मार्केटिंग प्राइवेट लिमिटेड तथा आवेदन पत्र में उल्लिखित व्यक्ति "डायरेक्ट सेलर" के मध्य किया जा है।

कंपनी डायरेक्ट सेलर को कंपनी के उत्पादों एवं सेवाओं के प्रचार, विपणन एवं बिक्री हेतु एक स्वतंत्र डायरेक्ट सेलर के रूप में नियुक्त करती है। डायरेक्ट सेलर कंपनी की नीतियों, नियमों, आचार संहिता (Code of Conduct), आय योजना (Compensation Plan) तथा लागू कानूनों का पालन करने हेतु सहमत हैं।

डायरेक्ट सेलर यह घोषणा करता/करती है कि: उसकी आयु 18 वर्ष या उससे अधिक है। वह भारतीय कानून के अनुसार अनुबंध करने हेतु सक्षम है। आवेदन पत्र में दी गई सभी जानकारी सही एवं सत्य है। उसके पास वैध पहचान एवं पते के प्रमाण उपलब्ध हैं।

डायरेक्ट सेलर कंपनी का कर्मचारी, एजेंट, भागीदार या प्रतिनिधि नहीं होगा। डायरेक्ट सेलर स्वतंत्र व्यवसायी (Independent Contractor) के रूप में कार्य करेगा। अपने कर (Tax), शुल्क एवं अन्य वैधानिक दायित्वों का उत्तरदायित्व स्वयं डायरेक्ट सेलर का होगा।

डायरेक्ट सेलर को निम्नलिखित अधिकार प्राप्त होंगे: कंपनी के उत्पादों एवं सेवाओं का प्रचार एवं विक्रय करना। कंपनी की आय योजना के अनुसार कमीशन, बोनस एवं प्रोत्साहन प्राप्त करना। कंपनी द्वारा उपलब्ध कराए गए प्रशिक्षण एवं व्यवसायिक सहायता प्राप्त करना। कंपनी के अधिकृत डिजिटल प्लेटफॉर्म एवं संसाधनों का उपयोग करना।

डायरेक्ट सेलर: ईमानदारी एवं नैतिकता के साथ व्यवसाय करेगा। उपभोक्ता संरक्षण (डायरेक्ट सेलिंग) नियम, 2021 तथा अन्य लागू कानूनों का पालन करेगा। उत्पादों एवं व्यवसाय अवसर के बारे में सही जानकारी देगा। भ्रामक, झूठे या अतिरंजित दावे नहीं करेगा। ग्राहकों की जानकारी गोपनीय रखेगा।

डायरेक्ट सेलर निम्न कार्य नहीं करेगा: किसी भी प्रकार की अवैध, धोखाधड़ीपूर्ण या भ्रामक गतिविधि। पिरामिड योजना (Pyramid Scheme) या मनी सर्कुलेशन योजना का प्रचार। आय, बोनस या सफलता की गारंटी देना। कंपनी के उत्पादों के संबंध में झूठे दावे करना। कंपनी की अनुमति के बिना विज्ञापन या प्रचार सामग्री तैयार करना। कंपनी के नाम, लोगो या ट्रेडमार्क का अनधिकृत उपयोग करना।

ग्राहकों को उत्पाद, मूल्य, रिटर्न एवं रिफंड नीति की सही जानकारी प्रदान की जाएगी। ग्राहकों की शिकायतों का समयबद्ध समाधान किया जाएगा। ग्राहक संतुष्टि को सर्वोच्च प्राथमिकता दी जाएगी।

डायरेक्ट सेलर को कंपनी की अधिकृत आय योजना के अनुसार कमीशन, बोनस एवं प्रोत्साहन दिया जाएगा। कंपनी आवश्यकता होने पर कमीशन गणना में हुई त्रुटियों को सुधारने का अधिकार रखती है। लागू कर एवं वैधानिक कटौतियां कानून अनुसार लागू होंगी।

डायरेक्ट सेलर कंपनी की निम्न जानकारी को गोपनीय रखेगा: ग्राहक विवरण व्यवसायिक जानकारी विपणन रणनीतियां आय योजना संबंधी गोपनीय जानकारी कंपनी के व्यापारिक रहस्य)

यह अनुबंध कंपनी द्वारा स्वीकृति के दिन से प्रभावी होगा। अनुबंध तब तक प्रभावी रहेगा जब तक इसे समाप्त नहीं किया जाता। नवीनीकरण संबंधी नियम कंपनी की नीतियों के अनुसार होंगे।

कंपनी निम्न परिस्थितियों में अनुबंध समाप्त कर सकती है: कंपनी की नीतियों का उल्लंघन। गलत या भ्रामक जानकारी प्रदान करना। अवैध या अनैतिक गतिविधियों में शामिल होना। कंपनी की प्रतिष्ठा को नुकसान पहुंचाना। लागू कानूनों का उल्लंघन करना। डायरेक्ट सेलर भी लिखित सूचना देकर अपना अनुबंध समाप्त कर सकता है।

डायरेक्ट सेलर अपने कार्यों, नियमों के उल्लंघन अथवा कानून के उल्लंघन से कंपनी को हुई किसी भी क्षति, दावे या हानि के लिए स्वयं उत्तरदायी होगा।

कंपनी किसी भी अप्रत्यक्ष, विशेष या परिणामी हानि के लिए उत्तरदायी नहीं होगी जो डायरेक्ट सेलर के व्यवसाय संचालन से उत्पन्न हो।)

यह अनुबंध भारत के कानूनों द्वारा नियंत्रित होगा। इस अनुबंध से संबंधित किसी भी विवाद का निपटारा कंपनी के पंजीकृत कार्यालय के क्षेत्राधिकार वाले न्यायालय में किया जाएगा।

मैं घोषणा करता/करती हूं कि मैंने इस डायरेक्ट सेलर अनुबंध, कंपनी की नीतियों, आचार संहिता, गोपनीयता नीति, रिफंड नीति एवं आय योजना को पढ़ लिया है, समझ लिया है तथा उनका पालन करने के लिए सहमत हूं। डायरेक्ट सेलर विवरण

DIRECT SELLER AGREEMENT

The Company hereby appoints the Direct Seller as an independent contractor for the purpose of promoting and selling the Company's products and services in accordance with the Company's Policies and Procedures, Compensation Plan, Code of Conduct, and applicable laws. The Direct Seller accepts such appointment and agrees to comply with all terms and conditions of this Agreement.

The Direct Seller represents and warrants that: He/She is at least 18 years of age. He/She is legally competent to enter into this Agreement. All information provided in the application form is true, accurate, and complete. He/She possesses valid identity and address proof as required by law

The Direct Seller is an independent contractor and not an employee, agent, partner, franchisee, or legal representative of the Company. Nothing contained in this Agreement shall create any employer-employee relationship. The Direct Seller shall be solely responsible for his/her own taxes, expenses, and statutory obligations.

The Direct Seller shall have the right to: Purchase and promote Company products and services. Earn commissions, incentives, and bonuses as per the Company's Compensation Plan. Receive training, support, and marketing materials provided by the Company. Access Company business tools and systems as authorized.

The Direct Seller agrees to: Conduct business ethically and professionally. Comply with the Consumer Protection (Direct Selling) Rules, 2021 and all applicable laws. Provide accurate information regarding products, services, and business opportunities. Refrain from making false income, medical, or product claims. Protect customer information and maintain confidentiality.

The Direct Seller shall not: Engage in any unlawful, deceptive, misleading, or fraudulent practices. Promote any pyramid scheme or money circulation scheme. Misrepresent Company products, services, policies, or Compensation Plan. Use unauthorized advertising materials. Use the Company's name, logo, or trademarks without authorization. Make guaranteed income or success claims.

The Direct Seller shall provide customers with complete information regarding products and pricing. The Direct Seller shall assist customers with returns, refunds, and complaints as per Company policy. Customer satisfaction shall be given priority at all times.

Commissions, bonuses, and incentives shall be paid in accordance with the Company's Compensation Plan. The Company reserves the right to correct errors in commission calculations. Taxes, deductions, or statutory withholdings shall be applied where required by law.

The Direct Seller shall maintain the confidentiality of: Customer information Business records Compensation details Marketing strategies Company trade secrets and proprietary information Such obligations shall survive termination of this Agreement.

This Agreement shall become effective on the date of acceptance by the Company. The Agreement shall remain valid unless terminated in accordance with its terms. Renewal requirements, if any, shall be governed by Company policy.

The Company may terminate this Agreement immediately if the Direct Seller: Violates Company policies. Provides false information. Engages in illegal or unethical conduct. Damages the Company's reputation. Violates applicable laws or regulations. The Direct Seller may voluntarily terminate this Agreement by providing written notice to the Company.

The Direct Seller agrees to indemnify and hold harmless the Company, its directors, officers, employees, and affiliates from any loss, liability, claim, or expense arising from the Direct Seller's violation of this Agreement or applicable laws.

The Company shall not be liable for indirect, incidental, consequential, or special damages arising out of the Direct Seller's business activities.

This Agreement shall be governed by and interpreted in accordance with the laws of India. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts located at the registered office location of the Company.

This Agreement, together with the Company's Policies and Procedures, Compensation Plan, Code of Conduct, Privacy Policy, Refund Policy, and applicable rules, constitutes the entire agreement between the parties. DECLARATION BY DIRECT SELLER I hereby confirm that I have read, understood, and agree to abide by the terms and conditions of this Direct Seller Agreement and all Company policies.
